Isra-Mart srl: IATA calls EU-ETS unlawful

The International Air Transport Association (IATA) has told the EU Court of Justice in Luxembourg that its member airlines oppose "unilateral action" that extends the EU carbon market to flights that depart from or arrive at an airport in the region.

The EU plan "is not the right way to reduce international airline emissions, nor is it lawful," said Conor Quigley, an IATA lawyer.

But the EU's Emissions Trading System (ETS) move is a "practical example" of necessary action to prevent global warming, EU Climate commissioner Connie Hedegaard said.

The ETS already covers more than 11,000 businesses, many in mining and manufacturing. When aviation joins the ETS in January next year, it will be the ETS's second-biggest industry.
